MyTempah may collect and process your personal data where necessary to operate our business responsibly, protect and enforce our legal rights, manage risks, and comply with applicable laws, regulations and regulatory requirements.
This may include activities relating to corporate governance, legal proceedings, regulatory matters, audits, investigations and the handling of requests made by individuals or competent authorities.
Where necessary and permitted by applicable law, we may process or otherwise use your personal data to:
- Manage and resolve legal claims, complaints and disputes;
- Respond to or assist with regulatory investigations, inquiries or proceedings;
- Process and respond to requests relating to your personal data and other data subject rights;
- Respond to lawful requests, orders or requirements from law enforcement agencies, courts, regulators or other competent authorities;
- Comply with applicable laws, regulations, codes, guidelines and other legal or regulatory obligations relating to MyTempah and our services;
- Conduct corporate governance activities, internal controls, compliance reviews and business audits;
- Detect, investigate and prevent fraud, financial crime, misuse of our services and other unlawful activities; and
- Establish, exercise or defend MyTempah’s legal rights and interests.
Depending on the circumstances, the personal data processed for these purposes may include information such as your identity and verification details, account information, booking and reservation history, details relating to specific reservations, transaction and payment information, communications with MyTempah, and other information reasonably required to address the relevant legal, regulatory or corporate matter.
MyTempah will process such information only to the extent reasonably necessary for the applicable purpose and in accordance with applicable data protection and privacy laws.
PDPA
Legal Basis for Processing Personal Data
MyTempah processes your personal data in accordance with the Personal Data Protection Act 2010 (Act 709) and other applicable Malaysian privacy and data protection laws and requirements.
Depending on the nature of our relationship with you and the services you use, MyTempah may process your personal data for the purposes described in this Privacy Notice based on one or more applicable grounds, including where:
- You have provided your consent for the collection and processing of your personal data for the stated purpose;
- The processing is necessary to provide or facilitate the services you have requested, including creating and managing your account, processing bookings, arranging accommodation and travel-related services, processing payments, handling cancellations and refunds, and providing customer support;
- The processing is necessary to comply with applicable legal, regulatory or statutory obligations, including requirements imposed by government authorities, regulators, courts, law enforcement agencies or other competent authorities;
- The processing is necessary to protect or establish MyTempah’s legal rights and interests, including preventing fraud, investigating suspected unlawful activity, managing disputes, enforcing contractual terms and protecting the security of our Platform, customers and business partners; or
- The processing is otherwise permitted or required under applicable law.
The specific basis for processing will depend on the nature and purpose of the personal data involved and the circumstances in which it is collected.
Where MyTempah relies on your consent, you may withdraw that consent subject to applicable legal requirements and any consequences that may result from such withdrawal. Withdrawal of consent will not affect the lawfulness of processing carried out before the withdrawal.
MyTempah will collect and process personal data only for purposes that are relevant, appropriate and reasonably necessary for providing our services, operating our business, meeting our legal obligations and protecting our legitimate business interests, in accordance with applicable Malaysian privacy and data protection requirements.
Terms of Service
By accessing or using the MyTempah Platform, creating an account, making a booking, or otherwise using any service provided through the Platform, you acknowledge that you have read, understood and agree to be bound by these Terms of Service, together with any booking-specific terms, policies and conditions that apply to your use of our services.
These Terms govern your use of the MyTempah Platform and set out the terms under which MyTempah provides access to accommodation and other travel-related services offered by participating Service Providers.
If you do not agree with these Terms, you should not access, register for, or use the MyTempah Platform or make any booking through it.
Your Booking and Contractual Terms
These Terms, together with your booking confirmation, the applicable Service Provider’s terms and conditions, the accommodation or travel details displayed at the time of booking, and any other pre-contractual information provided to you before completing your booking, form the basis of the contractual arrangements applicable to your booking.
Depending on the nature of the service and the arrangement between MyTempah and the relevant Service Provider, MyTempah may act as an online booking platform, intermediary, agent, reseller, or in another capacity as disclosed during the booking process.
Each Service Provider remains responsible for delivering the Travel Experience in accordance with the terms applicable to your booking, including the accommodation, facilities, services and other commitments stated in the booking confirmation.
If Something Goes Wrong
If you experience a problem with your booking or Travel Experience, you should contact the relevant Service Provider and/or MyTempah as soon as reasonably possible.
MyTempah may assist with communicating with the Service Provider, investigating your complaint, coordinating a resolution, and facilitating refunds or other remedies where applicable under the terms of your booking.
You may submit a complaint to MyTempah through our customer support channels. Where applicable and legally available, you may also have access to recognised dispute resolution or other consumer redress mechanisms.
Privacy and Personal Data
Your acceptance of these Terms does not constitute blanket consent to the collection, use or disclosure of your personal data for all purposes.
MyTempah collects, uses, stores and otherwise processes personal data in accordance with our Privacy Notice and applicable Malaysian data protection laws. Where consent is required for a particular processing activity, MyTempah will obtain that consent separately where appropriate.
Our Privacy Notice explains how we process personal data, the purposes for which it may be used, the circumstances in which it may be disclosed to Service Providers and other relevant parties, and the rights available to you.
About These Terms
This section is intended to provide a simple overview of the purpose and structure of our Terms of Service. It does not replace or override the detailed provisions contained in these Terms.
The complete Terms of Service constitute the legally binding agreement governing your use of the MyTempah Platform and your bookings made through the Platform. In the event of any inconsistency between this summary and the detailed provisions of these Terms, the detailed provisions will prevail.
These Terms should be read together with the applicable booking conditions, cancellation and refund policy, Privacy Notice and any other policies or terms expressly incorporated into your booking.
