MyTempah Disclaimer Statement
MyTempah operates an online platform that enables customers to search for, compare and make bookings for accommodation and other travel-related services offered by participating Service Providers.
While MyTempah uses reasonable efforts to ensure that information presented on the Platform is accurate, current and reliable, MyTempah does not warrant or guarantee that all information, content, availability, prices, descriptions, photographs, facilities, ratings, reviews or other materials displayed on the Platform are complete, accurate, current or error-free at all times.
- Service Provider Responsibility
Accommodation, facilities and other Travel Experiences available through the MyTempah Platform are provided, operated or fulfilled by independent Service Providers.
The relevant Service Provider is responsible for the actual delivery and quality of the accommodation or Travel Experience, including the accuracy of its property information, facilities, services, room availability, check-in arrangements, cleanliness, safety, licences, permits and compliance with applicable requirements.
MyTempah does not own, operate or control every accommodation or Travel Experience listed on the Platform and does not guarantee the performance, conduct, quality or suitability of any Service Provider.
- Information on the Platform
Property descriptions, photographs, amenities, room details, location information, prices, availability, policies and other information may be provided or updated by Service Providers or other third parties.
Information may change from time to time and may contain inaccuracies, omissions or errors despite reasonable efforts to maintain the quality of the Platform.
Customers should review the information and booking conditions presented at the time of booking and contact the relevant Service Provider or MyTempah if clarification is required.
- Availability and Pricing
The availability and prices displayed on the Platform are subject to change until a booking has been successfully completed and confirmed.
A displayed price may also be subject to applicable taxes, fees, surcharges, deposits, payment charges or other amounts disclosed during the booking process.
A booking is not considered confirmed until the customer receives a valid booking confirmation from MyTempah or the applicable booking confirmation channel.
- Third-Party Websites and Services
The MyTempah Platform may contain links, integrations, payment services, advertisements, content or other services provided by third parties.
MyTempah does not control and is not responsible for the availability, accuracy, security, content, privacy practices or performance of third-party websites, platforms or services.
Your use of third-party services may be subject to separate terms and privacy policies imposed by those third parties.
- Reviews, Ratings and Customer Content
Reviews, ratings, photographs, comments and other customer-generated content may be displayed on the Platform.
Such content represents the views and experiences of the individuals who submitted it and does not necessarily represent the views of MyTempah.
MyTempah does not guarantee that every review, rating or customer submission is accurate, genuine or complete, although we may take reasonable steps to monitor, moderate or remove content that violates our policies.
- Platform Availability
MyTempah aims to maintain a reliable and secure Platform but does not guarantee that the Platform, website, applications, booking systems or related services will always be available, uninterrupted, secure or free from errors, viruses or other technical issues.
Access may occasionally be suspended, restricted or interrupted due to maintenance, upgrades, technical failures, security incidents, telecommunications problems or circumstances beyond MyTempah’s reasonable control.
- Travel and Personal Circumstances
Customers are responsible for ensuring that they have all documents, permissions, approvals, insurance and other arrangements necessary for their travel or accommodation requirements.
Where applicable, customers should independently verify matters such as identification requirements, entry requirements, local regulations, health or safety requirements, insurance coverage and other travel-related requirements relevant to their circumstances.
MyTempah does not provide immigration, legal, medical, insurance or other professional advice unless expressly stated.
- Force Majeure and Events Beyond Our Control
MyTempah and/or Service Providers may be affected by circumstances beyond reasonable control, including natural disasters, severe weather, pandemics or public-health emergencies, government actions, civil unrest, war, terrorism, strikes, labour disputes, utility failures, telecommunications failures, cyber incidents and other unforeseen events.
MyTempah will use reasonable efforts to assist affected customers where practicable and in accordance with the applicable booking terms and applicable law.
- No Unauthorised Reliance
Information available through the MyTempah Platform is provided primarily for the purpose of facilitating travel and accommodation bookings.
Customers should not rely solely on general information on the Platform where a specific confirmation or professional advice is required.
Any specific booking conditions, confirmation details, cancellation terms and other contractual information applicable to a customer’s reservation should be reviewed carefully before relying on them.
- Limitation of Disclaimer
Nothing in this Disclaimer is intended to exclude, restrict or limit any liability, right, remedy, warranty or obligation that cannot lawfully be excluded, restricted or limited under applicable Malaysian law.
Where applicable law provides a customer with mandatory consumer rights or remedies, those rights and remedies remain unaffected.
- Acceptance
By accessing or using the MyTempah Platform, you acknowledge that you have read and understood this Disclaimer and agree that your use of the Platform is subject to this Disclaimer, the MyTempah Terms of Service, applicable booking conditions and other policies published by MyTempah.
This Disclaimer should be read together with the MyTempah Terms of Service, Cancellation & Refund Policy and Privacy Notice.
